Privacy policy

This policy explains how Forkd collects, uses and protects personal information, in line with the Protection of Personal Information Act, 2013 (POPIA). It covers this website, the forms on it and the private pages we prepare for businesses. It does not replace the written agreement we sign with a business that uses Forkd.

1. Who we are

The responsible party for personal information collected through this website is Forkd Tech, Johannesburg, South Africa. You can reach our Information Officer at info@forkd.tech.

When a business uses Forkd to look after its own clients, that business is the responsible party for its clients’ information and Forkd acts as its operator, under a written operator agreement. This policy does not cover that processing.

2. What we collect

• Request forms. When you request a demo or a website quote we collect your name, business name, industry, your website or Instagram handle, your phone number or email address, and anything you write in the message box.
• Private pages. If we prepare a private page for your business we use information that is publicly available about it, such as your website, public business profiles and public reviews, together with details you have told us.
• Technical information. To keep our forms safe from spam we briefly use your connection address to limit how many requests one connection can send. This website uses Google Analytics to understand how it is used. It sets cookies and sends usage information, such as the pages you view, your approximate location and your device type, to Google, which may process it outside South Africa. We do not use advertising cookies. You can block analytics cookies in your browser settings or with Google’s opt-out browser add-on.

3. Why we use it

• To reply to your request and give you the demo or quote you asked for.
• To prepare and send you a private page for your business, and to follow up about it.
• To run, secure and improve this website.
• To meet our legal obligations.

We rely on your consent where you give it, on steps you ask us to take before a contract, and on our legitimate interest in contacting businesses about services that are relevant to them. We only contact you about our own services.

4. Direct marketing and opting out

If we contact you about Forkd, you can ask us to stop at any time by replying “stop”, using the opt-out link on a private page, or emailing info@forkd.tech. We will record your request and will not contact you again for marketing.

5. Private pages

A private page is reached only by its link. It is hidden from search engines, it stops working on the date shown on the page, and the offer countdown on it is a real deadline. You can ask us to remove a page at any time.

6. Who we share it with

We share personal information only with service providers who help us run Forkd, such as website hosting, email delivery and messaging and booking infrastructure, and only as far as needed. We do not sell personal information. Some providers process information outside South Africa, including in the United States. Where this happens we take reasonable steps to make sure the information is protected to a standard comparable to POPIA.

7. How long we keep it

We keep demo and quote requests for 24 months unless you ask us to delete them sooner or you become a client, in which case the agreement we sign sets out what we keep and for how long.

8. How we protect it

We use reasonable technical and organisational measures to protect personal information against loss, misuse and unauthorised access. If a breach affects your information we will tell you and the Information Regulator as the law requires.

9. Your rights

You may ask us to confirm what personal information we hold about you, to see it, to correct it, to delete it, or to stop using it, and you may object to its use for direct marketing. Contact our Information Officer at info@forkd.tech. If you are not satisfied with our response you may complain to the Information Regulator at inforegulator.org.za.

10. Changes to this policy

We may update this policy and will show the date of the latest version at the top of this page.
